Compliance Corner: Lead generation
When contacting potential leads for enrollment, it is important to be aware of proper use of consumer and member information. All agents and brokers selling UnitedHealthcare Individual & Family Affordable Care Act (ACA) Marketplace plans are responsible for ensuring any lead, including those obtained from a third-party lead generation vendor and/or their up-line, comply with all federal and state laws and regulations and UnitedHealthcare policies, procedures, and rules.
Reaching out to prior leads who have since cancelled their policies to sell them a new plan may be considered an inappropriate use of a consumer’s personal information, and could potentially be considered a HIPAA violation.
